What is the Measure of a Felony?

A felony is a classification of a crime that is the most severe class. Felonies and misdemeanors are decided on a crime-by-crime basis in the state of Georgia, whereas other states have set definitions and parameters about what makes a felony a felony and a misdemeanor a misdemeanor. There are still hard-and-fast felonies in GA. Murder is punishable by the death penalty and other serious crimes (such as kidnapping and armed robbery) are frequently penalized by ten to twenty-five years in prison. Crimes such as rape or those which involve rape can incur incarceration of 25 years to life without parole.

What Are Wobbers?

Other felonies may be referred to as “wobblers.” Wobblers is a term lent to crimes that can be punished as either a felony or misdemeanor depending on circumstances (what the crime involved, if violence was a factor, what your criminal history is if any). For example, in the case of a wobbler, a judge may choose to sentence a conviction of a felony with a prison sentence of 10 years or less to a misdemeanor.

Violent Felonies are never counted as wobblers. Violent felonies are specified in the following list – though not limited to the list:

  • Kidnapping where the victim is older than 14 years old – mandatory sentence of 10 years in prison
  • Aggravated molestation – mandatory sentence of 25 years in prison
  • Aggravated sexual battery – mandatory sentence of 25 years in prison
  • Aggravated sodomy – mandatory sentence of 25 years in prison
  • Armed robbery – mandatory sentence of 10 years in prison
